General Terms and Conditions

  1. By the sole act of placing an order, the customer agrees to these general terms and conditions, which take precedence over and exclude any other.
  2. The delivery times are indicative only.
  3. Any alteration of, damage to or destruction of the sold item before delivery is presumed to be due to exceptional circumstances or force majeure.
  4. Aisin includes the following under force majeure or exceptional circumstances: strikes, unrest, war, riots, abnormal bad weather, equipment breakdowns or accidents, fire. Consequently, should these events occur, Aisin may suspend the fulfilment of its obligations or terminate the contract without damages due to the contracting party.
  5. Aisin is not bound by any guarantee in the event of an undetectable hidden defect.
  6. Goods travel at the buyer’s risk, even when delivery is free of charge.
  7. Goods remain our property until full payment is made.
  8. Unless otherwise stipulated, all payments shall be made in cash from the date of the invoice. Any invoice that remains unpaid at the due date will be increased by 20% with a minimum penalty of €50 as damages in application of articles 1152 and 1229 of the French Civil Code. The amount of the invoices shall also be increased by interest of 1% per month from when it falls due.
  9. Disputes must be sent by registered letter to the Aisin Europe head office within eight days and before any transformation of the goods.
  10. The sole competent court with regard to any dispute regarding this invoice is the court of Nivelles.
